Terms of service
Last updated 2026-10-23.
These terms are the agreement between Angelo Lamonaca (sole proprietorship), trading as Neuramare, in Switzerland (UID CHE-491.417.985; “Kennmarq.com”, “we”), and the business that uses Kennmarq.com (“you”). Whoever accepts them for an organisation confirms they may bind it. Kennmarq.com is for businesses and professionals only: by accepting these terms you confirm that you use it for a business or professional purpose, not as a consumer. Our privacy policy and, where we process personal data for you, the data processing agreement are part of these terms.
1. The service
Kennmarq.com marks AI-made files: an invisible watermark, and signed, time-stamped C2PA Content Credentials. It also checks files for marks, screens pictures with a safety check, signs manifests made on your own machine (local mode), keeps a public transparency log of what it signs, and offers SDKs and ComfyUI nodes. The documentation describes each part and its limits; we may improve, add or retire features, and the API keeps its promises of versioning.
Kennmarq.com helps you meet the marking duty of Art. 50(2) of the EU AI Act and the measures of the Code of Practice on marking AI-generated content. It doesn't guarantee compliance with them or with any law. You stay the provider or deployer under the AI Act, responsible for your systems and what they make; the AI Act lets a provider rely on a specialised vendor for marking, and keeps it responsible.
2. Accounts and keys
- Give true details, keep them current, and keep your passwords and API keys secret: what is done with them counts as yours.
- Use test keys for testing: their marks are signed with a test certificate that validators don't trust.
- Tell us at once at security@kennmarq.com if you suspect a key or an account is misused, and revoke the key in the dashboard.
- One free organisation per person and per company: creating several to stack free allowances isn't allowed.
3. Plans, fees and taxes
- Plans, allowances and prices are those on the pricing page when you choose a plan. Paid plans are billed in advance, monthly or yearly, through Stripe, and renew until cancelled. You cancel at any time in the dashboard; the plan then runs to the end of the period already paid, and isn't refunded unless the law says so.
- Monthly paid plans run past their allowance into the extras the pricing page lists, billed after the month, up to 10 times the allowance. Free and annual plans stop at their allowance.
- Prices exclude taxes; VAT or sales tax is added where it's due.
- We may change prices, allowances or the Free plan with at least 30 days' notice by email to the organisation's owners; a change to a paid plan applies from its next period after the notice. If you don't accept it, cancel before it applies.
- If a payment fails, the plan stops at its allowance until it's paid; after 30 days unpaid we may suspend the account.
4. What you are responsible for
- Declaring the source truthfully. You tell us how each file was made (created, composite or edited with AI), and we record what you declare. Mark only files made or changed with AI, and never present a marked file as a camera capture.
- Passing the rule on. If you let others make or use files you mark, your terms must forbid them to remove or alter the marks, as the Code of Practice's Measure 1.2 asks.
- Your files and what you do with them. You hold the rights the files need, and their content and use are lawful. Don't put personal data in the fields that go into a mark (title, model, app name): marks travel with the file and anyone can read them.
- The safety check is a signal, not a decision. It estimates what a picture shows, with the error rates the documentation publishes; it misses some cases and blocks some wrongly. You decide what to publish and remain responsible for it.
5. Acceptable use
You must not use Kennmarq.com:
- for anything illegal, above all sexual content involving minors, which our safety floor refuses on every cloud mark whatever the plan;
- to make content that harms, deceives or infringes the rights of others, or to deceive anyone about where a file comes from;
- to obtain our signature on claims that aren't true, or to sign anything but your own AI-made files;
- to get round limits, plans or the safety floor, or to probe, overload or attack the service or its users;
- to build a competing marking service from ours.
6. Suspension and termination
We may suspend keys or an account at once where we reasonably believe they break these terms, put the service or others at risk, or where the law requires it, and we tell you why unless the law forbids it. You may end the agreement at any time by deleting your organisations. We may end it with 30 days' notice, or at once for a serious breach. At the end, your keys stop working and we delete your account data as the privacy policy says; marks already made stay valid, and the transparency log keeps its entries, which hold hashes, never your files.
7. Our signature
Live marks are signed with Kennmarq.com's certificate, which names us, not you, as the signer, and time-stamped by our own time-stamp server. Until our certificate is on the C2PA trust list, validators may show the signer as unknown; the documentation says when that changes. Test keys sign with a test certificate.
8. Rights
Your files and what you make stay yours: you give us only the right to process them to provide the service. The service, its software and its brand stay ours, except the parts we publish under open-source licences (the SDK, the ComfyUI nodes, the checker), which their licences govern. If you send us feedback, we may use it freely.
9. Availability
We run the service with care and publish its state at status.kennmarq.com. Free, Indie and Startup plans have no availability commitment; Scale has a 99.5% monthly target, and Enterprise contracts set their own terms. A target is what we aim for, not a promise: missing it gives no right to a refund, a credit or damages. We may interrupt the service for maintenance, preferably announced.
10. Warranty and liability
The service is provided as it is and as available, without any warranty. We don't warrant that it is uninterrupted, secure or free of errors, that it suits your purpose, or that using it makes you compliant with any law; nor that a mark survives every edit or is read by every validator, nor that the safety check finds every picture it should and blocks none it shouldn't.
As far as the law allows, we exclude all liability for damage or loss of any kind, direct or indirect: among others lost profit, lost data, interrupted business, fines or penalties imposed on you, and claims of third parties, whatever the legal ground (contract, tort or any other). This exclusion covers slight negligence, and the acts of our auxiliaries and sub-processors in full (Art. 101(2) of the Swiss Code of Obligations). What remains is only the liability the law doesn't let anyone exclude in advance: for damage we cause intentionally or through gross negligence (Art. 100(1) of the Code of Obligations), and liability that mandatory law imposes.
You indemnify us and hold us harmless against all claims of third parties, and all fines, penalties and costs (reasonable legal fees among them), that arise from your files, your declarations, your use of the service or your breach of these terms.
11. Changes to these terms
We may change these terms. We announce material changes at least 30 days ahead by email to every organisation's owners and on this page; using the service after they apply is accepting them. If you don't accept them, stop using the service and close your organisations before they apply.
12. Law and courts
Swiss law governs this agreement, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts are the ordinary courts of the Canton of Zug, Switzerland.
